Introduction

At Benchmark Home Services Inc., operating under the trade name Sound Signs, we are committed to protecting intellectual property rights and adhering to the stipulations of the Digital Millennium Copyright Act (DMCA). This policy outlines our approach to addressing and mitigating copyright infringement related to our services. Usage of Sound Signs services is governed by our Terms of Service, which this Copyright Infringement Policy is a part of.

Should you suspect that your copyrighted work, or that of someone you represent, has been infringed upon via our platform, we encourage you to inform us by contacting our designated Copyright Agent. Please provide the following information in your notification:

  1. Your signature or that of the individual you represent, either physical or digital.
  2. A detailed list of the copyrighted works claimed to have been infringed.
  3. Precise identification of the allegedly infringing content, along with enough details for Sound Signs to locate the material within our services.
  4. A declaration of your belief, in good faith, that the disputed use of the material is not authorized by the copyright owner, their agent, or the law.
  5. Your contact details: mailing address, telephone number, and email address if available.
  6. A statement, under penalty of perjury, affirming the accuracy of the information in the notification and your authorization to act on behalf of the copyright owner.

Response to Infringement Notifications

Upon receiving a valid infringement claim, Sound Signs will:

  • Remove or disable access to the infringing material.
  • Notify the alleged infringer of the action taken.
  • For repeat infringers, terminate access to our services.

Counter-Notification Procedures

If you believe your content was mistakenly identified as infringing, you may submit a counter-notification to our Copyright Agent with:

  1. Your physical or digital signature.
  2. Identification of the content that was removed or disabled and its former location.
  3. A statement that you believe, in good faith, the content was removed or disabled by mistake or misidentification.
  4. Your contact information, and an agreement to the jurisdiction of the Federal Court in your area, or if outside the U.S., the jurisdiction where Sound Signs is located.

Upon receiving a counter-notification, Sound Signs may inform the original complainant, potentially leading to the restoration of the removed content unless further legal action is taken by the complainant.
